Terms and Conditions

1. Scope

These Terms and Conditions (T&Cs) apply to all contracts between Check your Potential and consumers within the meaning of Section 13 of the German Civil Code (BGB) who use services or offers from Check your Potential via the website or by other means. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.

2. Conclusion of Contract

The presentation of products or services on the website does not constitute a legally binding offer, but an invitation for the customer to submit a binding offer. By submitting an order, the customer makes a binding offer to conclude a contract. The contract is formed once Check your Potential accepts the order by sending an order confirmation by e-mail or by performing the service.

3. Services and Availability

Check your Potential endeavours to provide the services and content offered with as few interruptions as possible. However, continuous and error-free availability cannot be technically guaranteed at all times. Maintenance work, further developments, or malfunctions may lead to temporary restrictions. Claims for damages due to temporary unavailability do not exist.

4. Prices and Payment

All prices are stated in euros and include statutory VAT unless expressly indicated otherwise. The payment methods available in each case are displayed during the ordering process. Unless otherwise agreed, the invoice amount is due for payment immediately upon conclusion of the contract.

5. Liability

Check your Potential is liable without limitation for damages arising from injury to life, limb, or health resulting from an intentional or negligent breach of duty, as well as for damages caused by intentional or grossly negligent conduct.

In the event of slightly negligent breaches of material contractual obligations (cardinal duties), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded. The statutory provisions of the Product Liability Act remain unaffected.

6. Liability for Links

The website may contain links to external third-party websites, the content of which Check your Potential has no influence over and for which no warranty is assumed. At the time of linking, unlawful content was not recognizable. Permanent monitoring of the linked pages is not reasonable without concrete indications of a legal violation. If such infringements become known, the corresponding links will be removed without delay.

7. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal pursuant to Section 355 BGB. The legally required information on the right of withdrawal and the model withdrawal form can be found below.

Instructions on Withdrawal

Right of withdrawal:
You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Check your Potential, Güllstraße 4, D-80336 Munich, e-mail: [email protected], phone: +49 151 23 43 95 19) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or e-mail). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal:
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and not later than fourteen days from the day on which we receive notification of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in no event will you be charged any fees for such reimbursement.

Exclusion or early expiry of the right of withdrawal:
The right of withdrawal expires early if Check your Potential has fully performed the service and performance has only begun after you expressly agreed that we would commence performance before the expiry of the withdrawal period and you simultaneously confirmed that you are aware that you will lose your right of withdrawal upon full performance of the contract by us.

8. Changes to these T&Cs

Check your Potential reserves the right to amend these T&Cs to the extent necessary to adapt to legal or technical developments. Customers will be informed of any changes in text form. If the customer does not object within six weeks of receipt of the notification, the changes shall be deemed accepted.

9. Severability Clause

Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, the statutory regulation that most closely reflects the economic purpose shall apply.

10. Applicable Law and Online Dispute Resolution

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

Check your Potential is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
